2. Scope of Application
These Terms of Service apply to all digital products offered by Dizzy Records, including drum kits, melody kits, samples, loops, and other sound materials (“Products”).
By purchasing or downloading any product from our store, you agree to these Terms.
3. License and Usage Rights
When purchasing a product, you are granted a non‑exclusive, non‑transferable, perpetual license to use the included sounds and samples in your own musical compositions and productions, both commercial and non‑commercial.
- All products are 100% royalty‑free after purchase.
- You may not resell, redistribute, share, or repackage the original files, whether for free or as part of another sample pack, plugin, or product.
- You may edit, process, and combine the sounds with your own material to create new musical works.
4. Prices and Payment
All prices are final and include VAT where applicable.
Dizzy Records operates under the small business regulation (§ 19 UStG); VAT is not itemized on invoices.
Payments are processed securely through authorized payment providers.
We reserve the right to modify prices or discontinue products at any time.
5. Delivery of Digital Products
Delivery takes place digitally only.
After successful payment, download links will be provided via order confirmation or email.
Please back up your purchased files promptly — long‑term download access cannot be guaranteed.
6. Right of Withdrawal (Widerrufsrecht)
According to EU consumer law (§ 356 (5) BGB), the right of withdrawal for digital content expires once the performance of the contract has begun — that is, when the download link is provided, after the customer has expressly agreed to the start of delivery and acknowledged that this results in the loss of their right of withdrawal.
Withdrawal policy:
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day the contract was concluded.

by means of a clear statement (e.g., email) of your decision to withdraw from the contract.
Sending your notice before the 14‑day period has expired is sufficient to meet the deadline.
If you request that the digital delivery begin before the withdrawal period ends and receive the download link, you lose your right of withdrawal once the digital product has been made available.
7. Warranty and Liability
If any download file is defective or unavailable, Dizzy Records will provide a replacement link.
Further liability for direct, indirect, or consequential damages arising from the use or inability to use the products is excluded.
Our liability is limited to the amount paid for the product concerned.
8. Intellectual Property
All site content, sound files, artwork, and branding remain the property of Dizzy Records or its licensors.
Purchase of a product grants the usage license described in section 3 only — not ownership of the files.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany.
Where legally permitted, the place of jurisdiction is Wuppertal, Germany.
10. Modification of Terms
Dizzy Records reserves the right to update or modify these Terms at any time.
The effective version will be published on this page.
By continuing to use the store after any changes, you accept the new Terms.
